TUPE and protected salary

  1. Dear All,
    I am a frequent visitor but and infrequent poster. At the moment though I could use some advice from someone knowledgable! Any help would be most welcome.
    My school is closing and re-opening as a foundation trust. I am currently a subject leader in the old school, with a TLR, and I also recieve a reduced timetable to fulfil my role properly. The new school is reducing management numbers, and I have lost my TLR, however as I understand it I will have my salary protected for some time under TUPE.
    In this period of time my employer has told me that I need to continue to carry out extra duties to earn this money, but I will no longer have time (a reduced timetable) to carry them out in. I will be on a full teaching timetable. I want to know if this is true. I would say that the extra classes I am now directed to take on will take up the time in which I am currently carrying out my teaching and learning responsibilities, and I am not willing to take on extra things outside my contracted hours. Can they make me do this extra work or lose my protected salary?

    You can be asked to undertake management duties of an equivalent level - but not the same ones as your salary is protected over. You cannot be asked to do this if you now have additional teaching allocation in the time formerly allocated for management duties.
