School turning academy whilst on mat leave

    I have been on maternity leave since May, and recently found out my school is turning into an academy in December. I had planned on taking a full year off, but obviously my employer will have changed by the time I go back. Does anyone know how this will effect my entitlement?

    Also, they've given us an ultimatum - either sign the contract with the academy or we can find a new job. Now, if I don't sign the new contract, thereby ending my employment with my current school, how would that effect my maternity payments? I.E. would I still have to pay back my payments to the LEA?

    Sorry if this sounds confusing! I'm pretty confused about it myself... baby brain!!

    In light of your proposed contractual changes it would be at the LEA and academies discretion whether to require repayment of enhanced maternity pay should you choose to terminate your employment. In practice, most of the time, an academy tupes across employment rights of those presently contracted by an LEA. It is worth checking the contract for 'changes' to your terms of proposed service - most common difference being school day, expected hours as 1265 per year need not apply. In porting your employment across, they should have considered such issues and made provision for folk such as yourself, or on long term sick etc.

    Union!!! NOW. There is a statutory framework (called TUPE) that covers transfer of undertakings. You must get proper advice...
