re-employment

  1. Does a headteacher have to re-employ a TA who was signed off for a year, been given a chance to go return with Occupational Health, not attended, and now wants to return to her old job.

    Was she dismissed? If so, then no.
    Is she still technically employed? If so, then yes. The head can insist on a return to work meeting before she comes back, however.
    I'm not clear from the information you give which is the case.
