  1. Can a head teacher, who employed a teacher friend to cover maternity without interview, make that position permanent without advertising or interviewing any other candidate?

    They can, but only if the Governing Body have agreed to the creation of the post within the staffing structure. It is generally considered bad practice not to interview as it may leave the school open to claims that they are not following anti-discrimination legislation and not following 'best value' by not seeking to get the best candidate for the job.
