Can you claim maternity pay while on supply?

    Hi all,

    I work for 2 agencies does anybody know if I can claim maternity pay? If so who pays it and how much will I get? any ideas :)

    Your agency is unlikely to be paying occupational maternity pay even if you are on their guaranteed work/pay scheme (most of which have been disbanded in recent years) as you have no contractual rights to a particular teaching job.
    You may have an entitlement to Statutory Maternity Pay which is about £100 or so per week for a defined period.
    Look at www.directgov.co.uk for benefits information.
    If you are on your own or in a low income household, you may also be entitled to other means-tested benefits.
    Citizens' Advice Bureau is a possible avenue for finding out what you may be entitled to. You could also get information at a jobcentre. Your employer should also be able to advise you.
     
  3. I received Statutory Maternity Pay while on long term supply contracts. It was 90% of my pay for the first 6 weeks and then £124 for the next 33 weeks, so a total of 9 months of maternity pay. (I am still at home with my 11 month baby)
    If you work for 2 agencies, it would be best if you could use the <u>same</u> payroll company, who will then technically be your employer. Otherwise neither will take responsibility for your smp and you might not qualify. I used Key. (and they worked the first 6 week bit out wrong, I made a formal complaint at the HMRC and Key then paid the correct amount, grrrrrrrrrrrr)

    If I remember correctly, you have to be employed the first 26 weeks of your pregnancy and 2 weeks before that. Continiously. School holiday weeks don't count.
    And don't tell your agencies that you are pregnant, they don't need to know. Hopefully you won't be too sick. If they know, they might intentionally give you no work for one week and then cause you not to qualify for SMP! You do need to tell your employer by week 25, who will then be the payroll company such as Key and send them a form you receive from the doctor.
    They use a 8 week period to work out how much you earn on average, in order to work out how much you will get those first 6 weeks after the baby. This period was more or less week15/16 to week 25. So, hopefuly this 8 week period won't fall into the summer holidays for you, otherwise it will work out a very low amount as an average, because as a supply teacher you don't earn in the holidays.
    It would be best if you could be in a long term role so that are employed every single week.

  5. Wiki is entirely right. Basically it depends on how long you have worked for the agency. It does not matter whether you have a permanent job in a school or you are working with an agency.
    What they will look at is how long you have worked for them continously. You need to speak to the HR person of the agency and they will calculate it for you. They will need your expected date of delivery and when you have started with them and also when you want to start your maternity leave.

    If you cannot get SMP, you can get maternity allowance which is 128.74 per week as from the 6th April 2011, your agency will need to provide you with a certificate called SMP1 and you will have to ask your midwife a MAT B1 form (as from the 26 weeks or so) and send it to the dwp along with an application form.



    I wonder if the ones who are answering this question have ever gone through the steps of claiming, it does not seem so!
     
  6. Ok, this is interesting, I had assumed that I would only be entitled to maternity allowance but not so sure now. I started working for my agency on 8th October 2010 and I was approx 4 weeks pregnant. I have continued to work for them at the same school and am not due to finish until may, baby is due in June. However I did not work for several weeks in December and January. Is it worth enquiring about smp?

    So it is not as bad as i thought.

    So I need to get as much work in as possible between week 15-25 of my preganancy to receive the best rate of pay for the first 6 weeks the baby is born.
    Fairy_nuff I would defiantly ask about SMP as it will still be better than matarnity allowance if you did a lot of work between week 16-25 of your pregnancy as this is the time when they work how much you are entitled to.
