Academy employment contracts

    When converting to academy status, are employees at risk of losing continuous service benefits if they subsequently leave and move to another school?

    Yes, if they move to a new employer. Continuous service should be preserved for those already employed by the school when it converts to an academy, if the transfer is TUPEd properly.

    But beware of how your conditions of service change by stealth after conversion.

    And how something you 'agree to' as a 'gesture of goodwill', suddenly becomes a definite working condition...

    So, TUPE ensures terms of continuous service remain the same if you stay with school as it joins multi academy trust. But, supposing six months later you decide to move to another school outside the trust, do you then lose the continuous service?

    If so, does this impact on pension?

    Yes. TUPE protects you during the move across. Sometimes if you take up a new post within the school you get put onto a new academy contract rather than a change to the existing contract.

    If the school you move to doesn't count continuous service from academies then you do lose continuous service for the purpose of sick pay, redundancy and maternity pay. I'm not sure about pensions though.

    Some schools do honour continuous service within the state sector. Quite a few people I know have moved between LA and academies and retained continuous service but it's at the school's discretion.
